TheApartment Seekers.com is owned and operated by Prime Real Estate Services, Inc. dba Apartment Seekers. Services we provide through our website are subject to certain terms and conditions which may be updated from time to time without notice to you. It is your responsibility as a user of our site to check our Terms of Use Policy to ensure you comply with and understand these guidelines. Once you register on the website, a representative from Apartment Seekers will contact you via phone or email to answer any questions you may have and periodically touch base with you via phone or email if you are seeking an apartment. Your online registration on Apartment Seekers website constitutes an “application” with our service which remains open until you contact us to close it or you make a final leasing decision and notify Apartment Seekers via phone, email or in person of your search results. Due to the nature of our business and how we are compensated by the properties we represent, registering with invalid contact information may result in you being blocked from further use of our website.

HOW OUR SERVICE WORKS:

1)Searching For An Apartment

We are paid a referral fee from the apartment communities whose properties you will find listed on our website if you conduct an apartment search. By using this search feature, you are required to:

1. List Apartment Seekers as your referral source on any application or traffic card if you visit or choose to lease at one of our contracted communities. Any roommates whose names you include on your profile on our website are also subject to the same conditions if you use our information to lease an apartment or other rental based on a search from TheApartmentSeekers.com.
2. Contact Apartment Seekers via phone, email or in person to inform us of your leasing decision. We track all this information which is why it is crucial that you contact us once you’ve made your leasing decision.

We will need to know the following:

1. Name of the community you are leasing at
2. Your move in date
3. Lease term/length of lease
4. All roommate’s names, if applicable

Regardless of how your search ends up, by using our website, you agree to contact Apartment Seekers so that your leasing decision can be recorded.

2)Roommate Matching Service

You must be 18 years of age or older if placing a roommate matching ad. You agree that any information you provide to us through our website is true and correct. Once you’re your profile is uploaded and approved you are responsible for all activities that occur under your account. You must notify us immediately if there is any unauthorized use of your account or any other breach of security. Any changes by you to your profile will be subject to re-approval by Apartment Seekers.

Member Conduct

You agree and represent that you are entirely responsible for all content you post or upload into your profile. You understand that you may be exposed to offensive, indecent or questionable content when you post your contact information. You agree that Prime Real Estate Services, Inc. dba Apartment Seekers will not be held liable for any content, including but not limited to, any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available through this service.

You agree to not use this service for any illegal or inappropriate purpose and affirmatively represent and warrant the following:

a) You will not upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, vulgar or obscene, invasive of another’s privacy, racially, ethnically religiously or otherwise objectionable.

b) You will not impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.

c) You will not upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters or any other form of solicitation, except in those areas that would be designated for such purpose.

d) You will not upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functions of any computer software, hardware or telecommunications equipment.

e) You will not stalk or otherwise harass other members on this site.

Acknowledgments

a) You acknowledge that all roommate matching profiles are subject to approval by Prime Real Estate Services, Inc., dba Apartment Seekers and that we have the right to refuse, move or remove any content on the site we deem reasonable. We may disclose to third parties in order to comply with a legal process, enforce our terms of service, respond to any claims that any content violates the rights of third parties or protect our rights, property or personal safety or the rights, property and personal safety of our users or the public.

b) You agree to indemnify and hold Prime Real Estate Services, Inc., dba Apartment Seekers, our affiliates, owners, employees or other partners harmless from any claim or demand, including attorney’s fees made by any third party due to or arising from content you submit, transmit or post or make available to us.

c) You acknowledge that Prime Real Estate Services, Inc., dba Apartment Seekers has the right to modify or discontinue this service at anytime. You agree that we shall not be liable to you or any third party for any modifications, suspensions or discontinuance of this service.

3) Private Listings and Sublease Advertising

a) Both services require payment in order for ads to be placed and are subject to the same terms and conditions as stated above for the Roommate Matching policy.

b) Fees paid for these services are non-refundable.

c) Please make sure to deactivate your ad once you find a tenant or someone to take over your lease in the case of a sublease.

Disclaimers, Violations, Deactivation

a) You expressly agree and understand that your use of this service is at your sole risk. We make no warranty that the service will meet your requirements, will be uninterrupted, timely or error free. We are always on the lookout for technical glitches that can affect how our site works. When we find them on our end, we will fix them as soon as possible. Unfortunately, your home computer may cause some glitches that affect your use of our site and that we cannot control.

b) Please report any technical issues or violations of our service to us immediately.

c) You may deactivate your account at anytime by using the deactivation feature in your profile settings.

d) We may terminate your account at any time for any reason, with or without cause, without prior notice to you and without liability or further obligation of any kind to you or any other party if we believe it to be in our best interest or in the best interest of our users.

e) If you fail to fulfill this agreement, you may be held liable to a $99 Service Fee or Referral Fee.
